Terms of Service
In effect from October 23, 2026
These terms are an agreement between Tyler Sacharow, doing business as Site Right (“Site Right”, “we”) and the company that opens a Site Right account (“you”). By creating an account or using Site Right you agree to them for your company, and you confirm you may do so.
In short: Site Right is a screening tool. It points you to land worth a closer look; it does not replace the title search, survey, engineering study, utility study or legal advice a purchase needs. Use the data for your own work, do not copy or resell it, and pay for the plan you choose.
1. What Site Right is
Site Right is software that shows land in the states it covers scored for data-center use: the parcels, the power grid around them, zoning and local rules, floodplain and other risks, an assistant that answers questions from that data, evaluations of land you name, and a reading of the utility documents you upload. Briefings, a short document of ranked sites our team builds for a client's requirements, are a separate service arranged with us directly; no plan includes one.
Every fact carries a label. “Confirmed” means we read it in a named public source; “Inferred” means we worked it out from such sources and it should be checked; “To confirm” means we do not know yet.
2. A screen, not advice
Site Right is information to help you decide where to look. It is not a title report, a survey, an appraisal, an environmental or geotechnical study, a utility's interconnection or capacity study, or a legal opinion on zoning. Nothing in Site Right promises that power is available at any substation or line, that a use is permitted, that land is for sale, or that an owner, price or boundary is current.
Public records change and can be wrong. Before you rely on a fact to buy, lease, option, finance or build, confirm it with the county, the city, the utility, the grid operator and your own advisers.
3. Accounts and your team
Each person uses their own account; do not share passwords or let one seat stand in for several people. Your company's owner chooses the plan and manages billing; owners and admins invite and remove people. You are responsible for what happens under your company's accounts and for keeping passwords safe. Tell us at hello@siterightpro.com if you think an account was used without permission.
4. Plans, limits and payment
Each plan includes the land, people and amounts shown on the Plans page: site profiles, questions to the assistant, exported sites and site evaluations. Monthly amounts reset on the first day of each month (UTC) and do not carry over. When an amount is used, that part of Site Right pauses until the next month or a larger plan.
Paid plans bought by card are charged when you choose them. Plans renew each month or year until cancelled. Prices are in US dollars and exclude taxes, which are added where the law requires. Payments are handled by Stripe. An upgrade takes effect at once and is charged pro rata; a downgrade takes effect at the next renewal. If a payment fails, the plan's paid features pause until it is paid: three days after the failed charge, or at once if it was the first payment. An account still unpaid after 30 days may be suspended.
Briefings are not sold in Site Right. A briefing, and a plan arranged with us by order form or invoice, follows that document where it differs from this section.
5. Cancelling and refunds
The owner can cancel at any time from Plans and billing; the plan runs to the end of the period already paid and is not renewed. We do not refund part-periods, except where the law requires it or where we end the service without cause (section 13).
6. How you may use the data
You may use Site Right for your company's own site selection, land acquisition, development, brokerage and advisory work, including showing a site's profile, a briefing or an export to your clients, partners, lenders and landowners about a specific deal.
You may not:
- copy, scrape, crawl or download Site Right's data in bulk, by script or by hand, beyond what your plan's exports allow;
- resell, sublicense or publish the data, or use it to build or improve a product that competes with Site Right;
- get around the plan's limits, the rate limits or the sign-in, or share an account outside your company;
- use Site Right to harass landowners, to misrepresent yourself, or against the law;
- probe, overload or attack the service, or try to reach data another company may see but you may not.
Part of the data is open data published by others under their own licences, which still apply to it; the Data and licences page lists them. In particular, power lines and substations come from OpenStreetMap under the Open Database License, and files you export that contain them carry that licence.
7. The assistant and briefings
The assistant writes answers with an AI model from Site Right's data. Every figure in an answer is checked against the data it looked up, and one it cannot confirm is marked, but an answer can still be wrong or incomplete; read the sources it names. A utility document you upload is read by the same kind of model, and each thing it reads keeps the page and words it came from; check them against the document. Briefings are written by our team with the same tools and checked by a person before delivery. Section 2 applies to both.
8. What you give us
Your questions, briefs, shortlists, notes and files stay yours. You give us permission to store and process them to run Site Right for you, to build your briefings, and to keep the service secure. We do not use them to train AI models, and we do not show them to other companies. We may use counts and patterns that identify neither you nor your sites to run and improve the service.
A briefing we build for you is for your company. We may use what we learn about places, rules and data quality while building it to improve Site Right for everyone, without revealing your search.
9. Our property and feedback
Site Right, its software, its scores and the data as we compile, check and present it belong to us or our licensors; these terms give you the right to use them under your plan, and no other right. If you send ideas or feedback, we may use them without owing you anything.
10. Confidentiality
Each side keeps the other's non-public information confidential and uses it only for this agreement. For you, that includes your searches, briefs and briefings; for us, the parts of Site Right that are not public. This does not cover what is public, already known, independently developed, or that must be disclosed by law (with notice where allowed).
11. Service providers
We use other companies to run Site Right: hosting, email delivery, payment (Stripe) and the AI models behind the assistant and the reading of utility documents (Anthropic's Claude, with OpenAI's model when Claude is unavailable; neither trains on what we send it through its API). They handle your information only to provide their service to us. The Privacy notice lists them.
12. Warranties and disclaimers
We will provide Site Right with reasonable skill and care and fix problems you tell us about within a reasonable time. Apart from that, and to the extent the law allows, Site Right and its data are provided “as is”, without any other warranty, including fitness for a particular purpose, accuracy, completeness or uninterrupted availability.
13. Suspension, ending and deletion
We may suspend an account that breaks section 6, puts the service or other companies at risk, or is unpaid as described in section 4, and we will tell you why. Either side may end the agreement if the other materially breaks it and does not fix the breach within 30 days of notice. We may end the service for everyone with 60 days' notice and refund the unused part of any prepaid period.
When an account ends, we delete your company's content within 30 days and from backups within 60 days, except what the law requires us to keep (such as invoices).
14. Limitation of liability
Neither side is liable for indirect, consequential or special losses, lost profits or lost deals, even if warned they were possible. Each side's total liability under these terms is limited to the amounts you paid us in the 12 months before the claim. These limits do not apply to a breach of section 10, to your breach of section 6, to amounts you owe us, or where the law does not allow them.
15. Indemnity
You will defend us against claims from third parties arising from your use of Site Right in breach of these terms, and pay what a court or a settlement you agree to awards.
16. Changes
We may change Site Right and these terms. We will give 30 days' notice by email of a change that reduces what your plan includes or changes its price, and it applies from your next renewal. If you do not agree to a change, you may cancel before it applies.
17. Governing law
These terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to its conflict-of-law rules. Disputes go to the state or federal courts in Massachusetts, and both sides consent to their jurisdiction.
18. General
These terms, with any order form, are the whole agreement about Site Right. If part of them cannot be enforced, the rest still applies. Neither side may transfer the agreement without the other's consent, except to a company that takes over its business. Notices to us go to hello@siterightpro.com; notices to you go to your company owner's email.
